Herein this document, all usage of the words "we", "us", and "our" refer to Alpha Layer Pty Ltd. The content of this Terms of Service document is a legally binding agreement for any account holders with Alpha Layer Pty Ltd. We reserve the right to terminate and cancel any client and service at any time, for any reason. Find the document listings below for a description of our terms.
All orders are checked to be valid within 12 (twelve) hours of the order being paid in full. Upon validating the order, at our sole discretion, may choose to suspend your service and request additional information or details from you or terminate your service. At any stage if your order is deemed by us to be invalid or fraudulent you will receive a full refund through the same method the invoice was paid with and your service terminated.
No content may be stored, accesses or transmitted that is illegal in Australia.
In addition the following applications, content and actions are not permitted to be stored or ran on our servers:
- Network abuse (port scanners)
- TOR (Exit or Relay)
- IRC servers and clients
- VPN and proxies may only be hosted for private use
- Mass mail or spam of any kind including opt-in mail lists
While due care is taken to preserve your data, technical faults do occur. In such case that your data does become corrupt or lost we claim no liability for any loss of income or any other loss that may result from the loss of data.
Late payment of invoices will result in your services being suspended. You will be able to reactivate your service by paying the invoice plus an overdue fee of 10%. After your invoice remaining overdue for 5 days past its due date we reserve the right to purge all data related to your service.
Cancellation requests can be made using the billing panel or direct email with a minimum of 48 hours notice before service renewal date. You will receive confirmation of the cancellation within 24 (twenty four) hours via email. Nonpayment of renewal invoices is not considered cancellation of your service.
All the services hosted with us are unmanaged. You are responsible for the security and management of your service. If we receive reports from third parties that your service is sending spam, is infected with malware, or is taking part in any activity that may negatively impact our business or other customers will result in an investigation. If the resulting investigation results in the claims being true, one of three actions will be taken of which you will be notified. These three actions being: notifying you, suspension of service and/or termination of service.
Nothing in this Agreement operates to exclude, restrict or modify the application of any provision, the exercise of any remedy, or the imposition of any liability under the Australian Consumer Law (Competition and Consumer Act 2010).
